Seed company has UAH 6mn fine reduced by UAH 2.5mn

Subject of complaint: Main Department of the State Fiscal Service of Ukraine in Kyiv (MD of SFS in Kyiv)
Complaint in brief: On July 21, 2016, the Complainant, an Austrian agribusiness engaged in the retail trade of seeds in Ukraine, lodged a complaint with the BOC regarding the outcome of a tax audit carried out by the MD of SFS in Kyiv. The resulting tax notification of decision slapped a fine of UAH 6 million on the company. The SFS decided to fine the company for allegedly insufficiently detailed accounting reports from the farmers with whom the Complainant cooperates.
Action taken: On August 9, the BOC investigator participated in an administrative hearing of the case at the SFS. The investigator supported the Complainant’s argument that there was no evidence that the reports lacked sufficient detail and presented sample documents and reports in support of its position.
Result achieved: As a result of the BOC investigator’s personal intervention at the SFS’s administrative hearing, the fine against the Complainant was reduced by UAH 2.5mn.
